Public Hearing: 4/25 Planning Commission Meeting

NOTICE IS HEREBY GIVEN that the PLANNING COMMISSION of the City of Pittsburg will conduct a public hearing in the City Council Chamber at City Hall on April 25, 2023, at 7:00 PM concerning the following item(s):

 

Pittsburg Landing AT&T Wireless Facility, AP-22-0122 (DR).

Design Review (DR) application to install a new approximately 80-foot-tall Monopole Telecommunications Facility (disguised as a stealth flagpole) behind an existing industrial building, the Mt. Diablo Landscape Center, which is located at 2665 Pittsburg – Antioch Highway. The proposal includes 12 antennas and associated appurtenances and ground-mounted generator and equipment cabinet within a 24’x25’ (600 sq. ft.) slatted chain-link fenced enclosure. The site is classified as Service Commercial in the General Plan land use map and zoned CS – Service Commercial District. Assessor’s Parcel No. 074-100-009. 

Environmental Determination:

The project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) under Class 32, “Infill” of the CEQA Guidelines, section 15332.

East Bay Auto Sales/Used Cars, AP-21-1591 (UP, DR).

This is a public hearing requesting approval of a Use Permit and Design Review to construct: (1) an approximately 798 square foot (sq. ft.) sales office, (2) 576 sq. ft. repair garage, and (3) an approximately 10,772 sq. ft. surface parking lot with 625 sq. ft. of landscaping improvements at 1025 Railroad Avenue, in the CS-D (Downtown Service Commercial) District. APNs: 085-204-005, 085-204-010 and 085-204-011.

Environmental Determination:

This project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) under Class 3, “New Construction or Conversion of Small Structures” of the State CEQA Guidelines, section 15303 which consists of construction and location of limited numbers of new, small facilities or structures.

Hernandez Towing, AP-22-0124 (UP).

This is a public hearing requesting approval of a Use Permit for temporary storage of towed/impaired vehicles obtained by local law enforcement within an existing, 7,500 square-foot space at the Empire Commerce Center located at 671 Willow Pass Road. The property is located in the IP-O (Industrial Park with a Limited Overlay) District. Assessor Parcel Nos. 085-260-184 and portion of 085-260-183.

The project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) under Class 1, “Existing Facilities,” of the CEQA Guidelines, section 15301.

Title 18 Text Amendments/Updates, AP-23-0002 (ZTA)

Staff has identified a variety of miscellaneous “clean-up” text amendments needed to address some ambiguities and inconsistencies in Title 18 of the Pittsburg Municipal Code (PMC) and to also update other sections in compliance with recently updated provisions of Accessory Dwelling Unit (ADU) State Law. The proposed amendments would clarify and correct some requirements that have been ambiguous or misinterpreted in the past and update some zoning definitions, use classifications and development standards for consistency with State ADU Law.

Environmental Determination:

The zoning text amendment is exempt from CEQA pursuant to CEQA Guidelines section 15061 (b) (3), which provides that a project is exempt from CEQA when it is covered by the general rule that CEQA only applies to projects which have the potential for causing a significant effect on the environment and does not apply where it can be seen with certainty that there is no possibility of a significant effect.

You are invited to submit comments regarding any aspect of this matter in writing or verbally at the April 25, 2023 public hearing. If you challenge the above matter in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Planning Commission at, or prior to, the public hearing.

Dalé Vino Wine Bar and Restaurant, (UP, OD).

Use Permit to allow existing restaurant with beer and wine service (Dale Vino), to expand its outdoor activities into adjacent public spaces for occasional special events involving live music. The expanded outdoor activities are for special events only and not daily operations, with the intent to also increase seating outdoors during special events and allowing for live music outdoors in the extended space. Outdoor events in the extended space would cease by 10:00 p.m. Dale Vino is located at 51 Marina Blvd., in the CW (Waterfront Commercial) District. Assessor Parcel Number 085-071-044.
